BUYER: The individual or legal entity registered on the LiveAlbum platform under the email address with which the agreement is electronically concluded.
This agreement covers purchases made from Türkiye and denominated in Turkish Lira (₺). For such transactions, the seller and merchant of record is Async Yazılım Bilişim Programlama San. ve Tic. Ltd. Şti.; payments are processed on the PCI-DSS compliant infrastructure of our global payment provider, Stripe. International transactions in foreign currencies, also processed via Stripe, are handled by the group company EEC LABS LTD (England and Wales) and are subject to the Terms of Service.
2. Subject
The subject of this agreement is the digital delivery of the premium service package (Business, Duo Package or Organizer) selected by the BUYER on the LiveAlbum platform, and the determination of the parties' rights and obligations in line with the TKHK and DCR.
3. Product and Price

The stated amounts are in TRY (VAT 20% included) for sales within Türkiye. For international sales, payment is collected in the currency applicable to the BUYER's country (USD/GBP/EUR). No shipping, setup, transaction or hidden fees are charged to the BUYER. The Business and Duo packages are one-time payments with no auto-renewal. The Organizer Plan is a monthly recurring subscription that renews automatically each month until the BUYER cancels. Premium membership includes a daily renewing AI generation allowance based on the purchased plan: 50 on the first day and 10 each following day for Business and Wedding Weekend; 100 per day for Organizer. Each generation and edit uses one from the allowance; unused daily allowance does not carry over.
Charges are processed via the Stripe Payments secure infrastructure for all domestic and international sales. Card data is not stored on the SELLER's servers; it is processed within PCI-DSS compliant infrastructure.
4. Payment

IP address, browser information and timestamp are logged at the payment step.
5. Delivery
The service is digital; plan features are activated on the BUYER's account immediately (typically between 5 seconds and 5 minutes) after payment confirmation. Details are set out on the Delivery Terms page.
6. Absence of Right of Withdrawal and Waiver (DCR art. 15/1-ğ)
The subject of this agreement is a digital service performed electronically and instantly. Under DCR art. 15/1-ğ, contracts for services performed electronically and instantly, and intangible goods delivered to the consumer instantly, fall outside the right of withdrawal.
By ticking the explicit consent checkbox at checkout, the BUYER expressly approves the immediate performance of the digital service upon payment confirmation and acknowledges, declares and undertakes that they waive the right of withdrawal under TKHK and DCR art. 15/1-ğ. This waiver is recorded in the SELLER's systems together with IP address, browser information and timestamp.
7. Performance Period
Under DCR art. 7, the SELLER fulfils its obligation within 30 days from the order date at the latest. For LiveAlbum services digital delivery occurs simultaneously with payment confirmation, so this period is effectively in the 5-second to 5-minute range. If delivery is delayed by more than 24 hours, the BUYER may invoke the exceptional refund procedure under Refund & Cancellation Policy art. 5.
8. Seller's Liability
The SELLER undertakes to provide the service as defined in the agreement, deliver to the BUYER all features advertised, and take reasonable steps to keep the service error-free. In the event of defective service, TKHK art. 13 and 15 apply; the BUYER must notify [email protected] within 30 days of discovering the defect. The SELLER's liability is capped at the total amount paid by the BUYER in the last 12 months, save for intent and gross negligence (Turkish Code of Obligations art. 115).
9. Personal Data
The SELLER processes the BUYER's personal data within the framework of Turkey's Personal Data Protection Law (KVKK) No. 6698 and related legislation. Data subject rights (KVKK art. 11), the privacy notice, explicit consent scenarios and category-based processing purposes are explained in detail on the KVKK Privacy Notice page. Data is processed and stored in Türkiye. Data is not used for marketing without explicit consent.
10. Confidentiality
The SELLER processes photos, videos, wishes and event information uploaded by the BUYER and guests solely for the purpose of providing the service; the data is not sold to third parties, used to train AI models, or repurposed in any other product or service. The guest code, link or QR assigned to the event is controlled by the BUYER, who may revoke access or hide the album at any time.
11. Intellectual Property
The LiveAlbum brand, logo, domain, interface design, prompt templates and source code are owned by Async Yazılım Bilişim Programlama San. ve Tic. Ltd. Şti.; they may not be copied, reverse-engineered or commercially redistributed without authorisation. All intellectual property rights in content uploaded by the BUYER and guests (under Turkish Copyright Law No. 5846) belong to the uploader; the SELLER obtains only a limited, worldwide, royalty-free service licence for the sole purpose of delivering the service.
12. Term and Termination
The agreement is concluded with a one-time purchase of a single package and remains in force for the duration of the package's archive period (Pro: 30 days, Business: 1 year). There is no auto-renewal. The BUYER may terminate the agreement at any time by deleting their account; data is then destroyed or anonymised in accordance with KVKK art. 7. The SELLER may unilaterally terminate the agreement in case of prohibited content or systemic breach (see Terms of Use art. 8).
13. Force Majeure
Natural disasters, war, epidemics, nationwide official quarantine, governmental regulation, disruption of public infrastructure, and other extraordinary events beyond the reasonable control of the parties are deemed force majeure. The parties' obligations are suspended for the duration of force majeure; if the cause persists for more than 30 days, either party may terminate the agreement without indemnification. In that case the unfulfilled portion of the price is refunded to the BUYER pro rata.
14. Dispute Resolution and Competent Courts
Disputes arising from this agreement are subject to Turkish law. For consumer transactions, Consumer Arbitration Committees or Consumer Courts have jurisdiction in line with the monetary thresholds the Turkish Ministry of Trade publishes annually; for 2026 the district Consumer Arbitration Committee upper limit is TRY 149,000. For consumer disputes the court of the BUYER's place of residence has jurisdiction; the SELLER does not invoke a Bursa venue clause in such disputes. For commercial (B2B) relationships, the Courts and Enforcement Offices of Bursa are competent.
Consent
By proceeding through the payment step, the BUYER declares that they have read and electronically accepted this agreement, the Pre-information Form, the KVKK Privacy Notice and the waiver concerning the immediate performance of the digital service. Each of the four consents is given as a separate checkbox; IP address, browser information and timestamp are recorded in the SELLER's systems.
