1. Scope
This procedure applies to photos, videos, wish notes and event content uploaded by Hosts or guests on the LiveAlbum platform. The service provider and hosting provider identity is in the Company Details section at the bottom of this page. Data is processed and stored in Turkey.
2. Copyright Infringement (Law 5846, Additional Article 4)
If the author or holder of related rights (including producers, performers, and broadcasters under Article 80) asserts an infringement, they submit the claim to LiveAlbum with the documents proving the right. Within 3 (three) business days at the latest, LiveAlbum blocks access to the content. The uploading user is notified within the same period. Restoring the content requires a counter-notice and the rights holder's consent.
3. Personality Rights (Law 5651 Articles 9 and 9-A)
Individuals or legal entities whose personality rights have been infringed may apply directly to the content provider or to LiveAlbum. Under Article 9, LiveAlbum evaluates the notification within 24 hours; if a clear infringement is identified, access is blocked. Otherwise, the affected party may seek an access ban from the Criminal Judgeship of Peace. Under Article 9-A, privacy violation claims may also be submitted through the ICTA (BTK); injunctions are enforced.
4. Required Information
For complete review, the application must include the following:
- Applicant's full name, Turkish ID or tax ID number, address, phone, and email.
- Authorisation document if filed on behalf of a legal entity (signature circular, power of attorney or representation certificate).
- Full URL of each item allegedly infringing (listed individually; bulk lists are not accepted).
- Proof of rights: copyright registration, authorship declaration under Law 5846 Article 13 et seq., trademark certificate, or identity photo for personality-rights claims.
- Express statement that use is unauthorised: 'Sharing this content on LiveAlbum has not been authorised.'
- Signed undertaking acknowledging the legal consequences of false statements (Turkish Penal Code Article 267 — defamation; Law 5846 Article 71).
- Wet or electronic signature of the applicant or their representative.
5. Filing Channels
Applications may be submitted through the channels below. If multiple channels are used, the timestamp of the first received submission applies:
- Email: [email protected] — with complete files attached as PDF.
- Registered mail with return receipt: the company address (at the bottom of the page).
- In urgent matters covered by Article 71 of the Copyright Law, the application may also be served by a notary.
6. Timelines
Copyright applications under Additional Article 4 are reviewed within 3 business days at the latest; personality-rights applications under Law 5651 Article 9 are reviewed within 24 hours at the latest. LiveAlbum notifies the applicant of the decision by email. Where the application is rejected, the reasoning is communicated in writing.
7. Right to Counter-Notice
The user who uploaded the content may submit a counter-notice to LiveAlbum within 7 (seven) days after the removal decision. The counter-notice must include documents proving lawful use of the content (use licence, authorship, explicit consent, etc.). LiveAlbum promptly forwards the counter-notice to the original applicant. If the applicant does not produce an order from the Criminal Judgeship of Peace or a competent court within 7 days, access to the content is restored.
8. Abuse of Process
Persons submitting unfounded takedown applications may face criminal complaints under Turkish Penal Code Articles 267 (defamation) and 268 (use of another's identity or identity information), as well as civil liability under Article 71 of the Copyright Law. LiveAlbum reserves the right to share IP, email and contact information of applicants identified as abusing the process with the competent authorities.
