By using LiveAlbum you accept the terms below. This document governs the contract between you and the service provider, Async Yazılım Bilişim Programlama San. ve Tic. Ltd. Şti..

Parties and Merchant of Record

LiveAlbum operates under a shared group company structure. For international transactions processed in foreign currencies via our global payment provider (Stripe), the governing party and merchant of record is EEC LABS LTD (Private company limited by shares, registered in England and Wales). Local operations and Turkish Lira (₺) transactions within Türkiye are managed by the group company Async Yazılım Bilişim Programlama San. ve Tic. Ltd. Şti. and are subject to the Distance Sales Agreement.

1. Definitions

The terms used in this document have the following meanings:

  • Service provider: Async Yazılım Bilişim Programlama San. ve Tic. Ltd. Şti..
  • Platform / LiveAlbum: The QR-based photo sharing, invitation, AI QR card generation and archive service operated by Async Yazılım Bilişim Programlama San. ve Tic. Ltd. Şti. at livealbum.app.
  • User (Host): The individual or legal entity that creates an account on LiveAlbum and runs an event.
  • Guest: The visitor who reaches the event page via the QR or link shared by the Host, and contributes photos, videos or wishes without creating an account.
  • User content: All photos, videos, wish notes, event names and invitation data uploaded by Hosts and guests.
  • Premium pack: The upgraded service set sold as Pro or Business with a single one-off payment.
  • Daily generation allowance: A right that renews every day on premium plans, used for AI QR card and invitation generation/editing.

2. Scope of Service

LiveAlbum is a web-based, QR-driven guest photo sharing platform for events (weddings, engagements, hennas, birthdays, baby showers, graduations and similar special days). The service includes event page creation, QR invitations, app-free guest uploads, the live wall, AI QR card generation, and archive storage. Data is processed and stored in Turkey.

3. Account Eligibility

Users opening an account declare that they are at least 18 years old. A person opening an account on behalf of a legal entity warrants that they are authorised to represent that entity. Your credentials (email, password) are your responsibility and must not be shared with third parties. Passwords are stored hashed with bcryptjs at 12 rounds. Suspicious access on your account should be reported to [email protected] without delay.

4. User Content and Licence

All intellectual property rights in the photos, videos, wish notes and other content you upload remain yours (under Turkey's Copyright Act, Law 5846, Article 5 et seq.). To provide the service, LiveAlbum obtains a limited, worldwide, royalty-free service licence — for display on the event page, guest downloads, archive storage and backup. The licence is bounded by your service term and archive retention. Your content is never used to train AI models, never sold to third parties, and never reused in another product or service.

5. Prohibited Content

The following content may not be shared on LiveAlbum; when detected it is removed without prior notice and the account may be suspended:

  • Any imagery or text depicting child abuse or the sexual or physical abuse of minors (Turkish Penal Code Article 103 et seq.).
  • Violence, suicide promotion, self-harm imagery.
  • Copyright infringement (Law 5846 Article 71 et seq.) — unlicensed music, brand logos, commercial imagery.
  • Third-party data in violation of Turkey's Data Protection Law (KVKK) — identity, contact, or health information shared without consent.
  • Obscene or pornographic content (Turkish Penal Code Article 226).
  • Hate speech, discrimination, racist content (Turkish Penal Code Article 216).
  • Spam, fraud, phishing, links to malware.
  • Any content listed under Law 5651 catalogue offences.

6. Guests and Third-Party Rights

The Host running the event is bound to respect the data-protection rights of attending guests and third parties appearing in the photos. Notifying guests in advance that image and audio recordings will be made, and obtaining the necessary explicit consent, is the Host's responsibility. LiveAlbum provides notice templates to help; legal responsibility for consent rests with the Host. If a third party visible in a guest-uploaded photo objects, removal requests can be sent to [email protected].

7. Children's Data and Parental Consent

Hosts wishing to share photos or videos of people under 18 must obtain the prior explicit consent of a parent or legal guardian. For content identified as relating to a minor, LiveAlbum applies additional safeguards (private by default, shorter archive retention, supplemental access logging). Where a child's best interests are at risk, LiveAlbum reserves the right to remove the relevant content without prior notice. Parents or guardians who detect that a child's content has been shared without consent may write to [email protected] and request removal within 72 hours. Violations may lead to account suspension and LiveAlbum reserves all rights of recourse.

8. Account Suspension and Termination

Accounts that share the prohibited content listed in Article 5, systematically infringe third-party rights, unilaterally reverse payment obligations by chargeback, or otherwise misuse the platform may be suspended or terminated without prior notice. On termination, the data portability right under Article 12 is preserved; you may export your data for 30 days after deletion. Payment and log records may be retained up to 10 years where legal obligations require.

9. Intellectual Property

The LiveAlbum brand, logo, domain, interface design, prompt templates and source code are owned by Async Yazılım Bilişim Programlama San. ve Tic. Ltd. Şti.; they may not be copied, reverse-engineered, or commercially redistributed without permission. AI-generated outputs such as QR cards and invitations belong to the user account that produced them; content-policy and copyright risks rest with that user. LiveAlbum preserves transparency that other users with similar prompts may produce similar outputs.

10. Service Changes and Archive

LiveAlbum takes reasonable measures to keep the service running, but may pause it temporarily for technical maintenance, infrastructure updates, or mandatory security action — with notice as soon as possible. Marketing phrasing such as 'lifetime access' is interpreted as: your archive remains accessible while the service provider continues to operate commercially. If the company winds down, the notice period and data export commitment in Article 14 apply.

11. Limitation of Liability

LiveAlbum is provided 'as is'. Direct and indirect damages arising from the service are capped at the total amount the user has paid to LiveAlbum in the last 12 months (within the limits of Turkish Code of Obligations Article 25 et seq.). This cap does not apply where the breach stems from intent or gross negligence. Because AI QR card generation is probabilistic, results may not always match expectations; in that case the daily generation allowance refund procedure under Article 13 applies.

12. Data Portability

In line with the data-subject rights in Turkey's Data Protection Law (KVKK Article 11/d-e), you can export all photos, videos and metadata in your account as JSON and ZIP. Export requests can be started from your account settings under 'Download my data' or sent to [email protected]. Requests are completed within 30 days; users are notified of any technical delay. If you then choose to delete the account, the termination clauses in Article 8 apply.

13. AI Content Disclaimer

LiveAlbum uses an advanced image-generation model for AI QR card and invitation creation. The following terms govern those generations:

  • Probabilistic model: The same prompt may yield different outputs at different times; the result may not match expectations. Text or typography errors may appear.
  • Daily generation allowance refund: If generation fails or the output is flagged as unusable, the daily generation allowance spent is restored automatically. The refund is visible in your transaction history with a 'refunded' note.
  • Ownership: The right to use AI-generated outputs belongs to the user who initiated the generation. LiveAlbum does not claim ownership; it acquires only a limited licence for archive storage.
  • AI training is NOT allowed: LiveAlbum does not use user-supplied photos, AI generation results, prompts, or event metadata to train AI models, nor does it sell or transfer these to third parties for training purposes.
  • Content-policy compliance: The prompt filter is aligned with the AI provider's content policy (sexual content, child abuse, violence, celebrity likenesses, copyrighted brands are blocked). When outputs that bypass the filter still violate the policy are detected, LiveAlbum reserves the right to remove them from the user's archive.
  • Celebrity faces and third-party copyright: If you see a celebrity face, a copyrighted character, or a brand-like logo in the output, you must not use the result commercially and should report it to [email protected]. LiveAlbum does not guarantee that every case is caught; liability for AI outputs that infringe third-party rights rests with the user who initiated the generation.
  • Transparency: LiveAlbum states that other users with similar prompts may produce similar outputs. There is no guarantee that your result is 'unique to you'.
  • Data processing location: Reference images and prompts sent during AI generation are processed in Turkey; further details are in the Privacy Policy.

14. Company Wind-Down Scenario

If Async Yazılım Bilişim Programlama San. ve Tic. Ltd. Şti. must cease operations, users are notified by email and a dashboard banner at least 90 days in advance. During this window, all users can export their content as ZIP and JSON via the data portability tool in Article 12. The unused portion of any premium payment is refunded pro-rata. The LiveAlbum infrastructure stays accessible in read mode throughout the window. A final export reminder is sent before data is destroyed per data-protection requirements.

15. Dispute Resolution

This agreement is governed by Turkish law. Consumer transactions follow the Consumer Protection Law (No. 6502) and the Distance Contracts Regulation; the Consumer Arbitration Boards or Consumer Courts have jurisdiction depending on the financial thresholds set annually by the Ministry of Trade. For consumer disputes, the consumer's place of residence has jurisdiction; LiveAlbum does not assert a Bursa-specific venue clause in those relationships. For business-to-business relationships, the Courts and Enforcement Offices of Bursa have jurisdiction.
